2.   In accordance with Clause 178(1)(b) of the Local Government (General) Regulation 2021, council decline to accept any of the tenders for the projects listed.

3.   In accordance with Clause (3)(e) of the Local Government (General) Regulation 2021, council resolve to enter negotiations with the two (2) lowest priced tenders with a view to enter contract in relation to the subject matter of the tender.

4.   In accordance with Clause 178(4)(a) of the Local Government (General) Regulation 2021, council has declined to invite fresh tenders or applications as referred to in subsection(3)(b)-(d) for the following reason:

a)   All submitted tenders exceeded the budget allocated. Further, a competitive outcome is required to satisfy constraints of the existing budget allocated.

5.   In accordance with Clause 178(4)(b) of the Local Government (General) Regulation 2021, Council considers the reasons for determining to enter negotiations with the person or persons referred to in subsection (3)(e).

a)   An appropriate outcome for the benefit of the community would be reached by negotiating with the two (2) lowest priced tenderers.

6.   The Interim General Manager be authorised to negotiate with the two (2) lowest priced tenderers named in the body of the report.

7.   Following the negotiation process, and submission of recommendations from the Assessment Panel, the Interim General Manager be authorised to execute contracts for the Gundagai Swimming Pool Amenities Refurbishment, if it is within the allocated budget.

2.   In accordance with Clause (3)(e) of the Local Government (General) Regulation 2021, council resolve to enter negotiations with the lowest priced tender with a view to enter into a contract in relation to the subject matter of the tender.

3.   In accordance with Clause 178(4)(b) of the Local Government (General) Regulation 2021, Council considers the reasons for determining to enter negotiations with the person or persons referred to in subsection (3)(e).

a)   An appropriate outcome for the benefit of the community would be reached by negotiating with Dalski Constructions.

4.   The Interim General Manager be authorised to negotiate with Dalski Construction to obtain a better outcome for the benefit of the community.

5.   Following the negotiation process, and submission of recommendations from the Assessment Panel, the Interim General Manager be authorised to execute contracts for the Carberry Park Amenities Block, if it is within the allocated budget.

Recommendation

1.   The Minutes of the Cootamundra-Gundagai Local Traffic Committee Meeting held on Thursday 10 August 2023, attached to the report, be received and noted.

2.   In consideration of the Cootamundra-Gundagai Local Traffic Committee recommendations detailed in the minutes, Council endorse the following:

2.1. That a NO STOPPING zone be installed for 42 metres northbound along the western side of Hovell Street, commencing from the Temora Street intersection, due to visibility issues caused by parked vehicles.

2.2. That the NO STOPPING sign located at the rear door of the Outback Bakery on Cooper Lane be replaced with a LOADING ZONE sign in order to provide a safe delivery location for associated businesses.

2.3. That Cooper Lane be recognised as an Access Lane with Service Requirements and that existing signage remain unchanged.

3.1         Sight Distance Concerns on the Corner of Temora and Hovell Street, Cootamundra

Recommendation

That a NO STOPPING zone be installed for 42 metres northbound along the western side of Hovell Street commencing from the Temora Street intersection due to visibility issues caused by parked vehicles.

 

Discussion

The Local Traffic Committee agree that a No STOPPING zone at this location would improve visibility and intersection safety.

 

3.2         Outback Bakery Loading Zone, Cootamundra

Recommendation

That the NO STOPPING sign located at the rear door of the Outback Bakery on Cooper Lane be replaced with a LOADING ZONE sign in order to provide a safe delivery location for associated businesses.

Discussion

With consideration of no-through lane access, the lack of suitable alternative unloading options and surrounding commercial businesses,  the Local Traffic Committee agreed that loading zone signage was a suitable solution for this location.  Associated businesses will be notified prior to installation.

 

3.3         Cooper Lane Signage Review, Cootamundra

Recommendation

That Cooper Lane be recognised as an Access Lane with Service Requirements and that existing signage remain unchanged.

Discussion

The Local Traffic Committee discussed Cooper Lane usage and understand the need to allow commercial operations to continue regardless of access concerns for private residences.  The lane will continue to operate with the current signage and will be monitored by Council.  All associated residents will be notified of the outcome and encouraged to contact Council to discuss concerns.

 

3.4         Disabled Parking on Bourke Street, Cootamundra

Recommendation

That a designated disabled car space be installed on the Bourke Street side of 46 Cooper Street, Cootamundra to accommodate JMA Legal customers requiring disability friendly access to the administration office.

Discussion

The Local Traffic Committee agreed that a diasbaled car park at this location was required for disabled access by JMA patrons.  Council noted that the access ramp was not compliant and would require an upgrade.  Council will approach JMA Legal with a concept design and discuss the financial implications for both organisations.

3.5         No Parking Signage at 84 Sheridan Street, Gundagai

Recommendation

That NO PARKING signs be installed to prevent vehicles blocking access to the storage units and mechanic’s workshop at 84 Sheridan Street, Gundagai.

Disscussion

The Local Traffic Committee agree that NO PARKING signs are required at this location in order to prevent future issues with access and business operations.

 

3.6         Driveway Clearance at 66 Thompson Street, Cootamundra

Recommendation

That the REVERSE ANGLE PARKING sign situated next to the driveway at 66 Thompson Street, Cootamundra be relocated 3 meters north of the driveway entrance to improve driveway navigation and safety.

Disscussion

The Local Traffic Committee agree that relocation of the parking sign will assist with driveway safety and visibility at 66 Thompson Street.

 

3.7         Pioneer Park Rest Stop & Camping Signage

Recommendation

That Cootamundra-Gundagai Regional Council apply with the Tourist Attraction Signposting Assessment Committee for tourism signage on Olympic Highway directing road users to the newly designated recreational vehicle rest stop and camping ground on the outskirts of Cootamundra.

Disscussion

Council will submit an application to the Tourist Attraction Signposting Assessment Committee (TASAC) to seek approval.  Once approved, TASAC will provide approval for signage.  TfNSW will provide sign design and contractor details.  Cost of signage is borne by Council. 

 

3.8         2023 Book Week Parade Cootamundra

Recommendation

That approval be given for the Cootamundra Community of Schools to hold the 2023 Book Week Parade on the 25 August 2023 subject to the following conditions:

a)   The temporary closure of Parker Street between Adams and McKay Street between 10:45am and 11:30am, including Bourke Street at Parker Street and the Woolworths carpark entry exit at Parker Street;

b)   That all businesses along the route be advised and road closures be advertised throughout the community;

c)   The event organiser complies with any conditions set by Council and the NSW Police;

d)   A Police escort is organised for the duration of the parade by the event organiser;

Discussion

The Local Traffic Committee were pleased for the return of the event and discussed traffic management and pedestrian safety.  The COC noting interested parties is still required.

 

 

 

3.9         2023 Sambafest Wallendbeen

Recommendation

That approval be given to the Wallendbeen Community Association to hold Sambafest 2023 on the afternoon and evening of 30 September subject to the following conditions:

a)   The temporary closure of sections of King Street, Lackey Street and Hoskins Street, including the intersection, surrounding the Wallendbeen Hotel from 3pm until midnight;

b)   An Event Management Plan is completed and submitted to Council;

c)   A Traffic Guidance Scheme is completed and submitted to Council;

Discussion

The Local Traffic Committee discussed event location and patron safety.  The Committee was notified of the attendance of two SES vehicles to assist with emergency situations if required. Council confirmed traffic control plans as suitable.  The COC noting interested parties is still required.

3.11  General Business

1.      Visibility concerns at the intersection of Hovell street and Parker street, Cootamundra.

RECOMMENDATION

That Council install a NO STOPPING sign at the compliant distance north of the Hovell Street intersection on Parker Street to improve visibility of oncoming traffic.

The installation of NO STOPPING signage will prevent vehicles stopping or parking too close to the intersection.  Council will monitor visibilty once the new signage is in place.

2.      Parker Street Median Strip Removal

The Local Traffic Committee have noted the concerns raised and will monitor the situation once

the HPAA is implemented. Traffic and pedestrian separation was discussed noting the need to

encourage the use of existing crossings by way of public education.

 

3.      Muttama Road Speed Zone Extension

TfNSW have requested a status update regarding work progress and require an estimated time

frame.

4.      Road Train Usage of Lewin’s Lane

TfNSW to follow up with their Access Advisor.

5.      Sheridan Street Line Marking Audit

TfNSW requested the relocation of the 40km/h HPAA sign from the western side of West Street to the eastern side of West Street on Sheridan Street. 

6.      Gundagai Council Car Park Exit Safety

The Gundagai Engineer Team will provide a concept design to the Local Traffic Committee proposing an alternative solution to the current traffic arrangement. 

7.      New Rules for Unattended Vehicles Leniency

The Local Traffic Committee agreed that leniency would be at the discretion of the Regulatory

Officer or Police Officer involved.  It was noted that further public education regarding the new

rules is required.

8.      Proposed IGA Cootamundra Development Application

The Local Traffic Committee discussed Parker Lane usage and agreed that lane deliveries are acceptable at the proposed location.  Pedestrain safety, car park access  and future one-way traffic arrangements were also discussed.  IGA are to be notified of the future one-way plans intended for Parker Lane.

9.      Future Local Traffic Committee Dates

Committee members discussed suitable options.  Tuesday of the same week was suggested as the most favourable day.  Consideration was also given to alternating locations between Cootamundra and Gundagai.  These changes will be considered for 2024.

10.  Slow Lane at Frampton’s Crossing on Olympic Highway

TfNSW Has requested traffic counter data with regard to heavy vehicle movement at the Frampton Crossroads intersection.  Council will install traffic counters at the earliest opportunity.

11.  Street Sign with Number Directions and Kerb Numbering

Report to be provided to the LTC regarding possible options.

12.  Pedestrain Crossing Signage on Parker Street to be replaced with Flexible Signage for Wide

Vehicle Access.

Concerns were raised regarding pedestrian and road user safety.  As the requested route is not a designated heavy vehicle route, and involves a school pedestrian crossing, flexible signage was not recommended at this location.

13.  Double Parking during Muscle Car Events

Concerns were discussed regarding double parking during specific vehicle events held in Cootamundra.  Council suggested alerting event organisers to the issue during the approval process.  Police enforcement would be required.

Recommendation

Council accept the offer from the NSW Government to enter the funded Community Recovery Officer (CRO) Program.

 

Introduction

Cootamundra Gundagai Regional Council experienced declared natural disasters as a result of storms and flooding in 2022 and as such are eligible for Disaster Recovery Funding Arrangements (DRFA) Assistance.

In response to these events across the state, the NSW Government has developed the Community Recovery Officer (CRO) Program.

Discussion

The CRO program is offered as an additional resource for disaster-impacted local councils to support, coordinate and facilitate community driven recovery, activities and events that contribute to the community's recovery from disaster. The program is designed to support disaster-impacted communities through their recovery by building the capacity and resilience of the local community and council, and strengthening the relationships between the council, local community organisations, state government agencies and the broader community. The activities undertaken by the CRO address community needs and build the community’s capacity to recovery from future disasters, whilst promoting preparedness. The CRO will work from a program framework developed by NSW Reconstruction Authority whilst being responsive to the needs of the Local Government Area in which they work.

Councils are responsible for providing day-to-day supervision of the appointed CRO, and the provision of assistance to the CRO in the financial administration of the program, such as the provision of ledgers, support with receipts and invoices and payslips for the submission of a financial reimbursement claim. The CRO will be expected to submit monthly reports to NSW Reconstruction Authority, along with a workplan (to be submitted in first 6-weeks of employment and quarterly thereafter) to demonstrate progress and activities that meet the agreed deliverables of the program. It is expected the CRO will participate in monthly State CRO Forums and liaise with NSW Reconstruction Authority Regional Delivery staff on local issues and recovery events and activities.

Daily tasks or suggested activities of a CRO may include (although not limited to):

• Establishment or expansion and facilitation of Community Resilience Network/s (CRN).

• Mapping and analysis of the impact of the disaster on community, its groups and networks, and community infrastructure

• identifying service gaps and mapping additional services already being implemented by new recovery partners.

• Participation in the local recovery committee and/or health and wellbeing sub-committee

• Assisting the Local Emergency Management Officer (LEMO) within council where appropriate.

• Linking with local community groups to input community needs/strengths and project ideas to inform development, planning and implementation of the Local Recovery Action Plan (Post Recovery Action Plan) and recovery activities.

• Supporting community driven activities and events including anniversary and memorial events.

• Liaising and working with key stakeholders, including collaboration with existing CROs and relevant support services where these are in place.

• Supporting the council communications team to develop recovery information for the community in multiple formats e.g., online content, newsletters, local media etc.

• Regular reporting to both the council and NSW Reconstruction Authority.

• Contributing relevant community information to the development or review of the Local Recovery Plan (Pre-event Recovery Plan)

Financial

The CRO program is a joint-funded initiative by the Australian and NSW governments under Category A of the Disaster Recovery Funding Arrangements (DRFA) and offered for a period of 12-months, with funds available until 30 June 2025. The following funding is available:

•  1 x Community Recovery Officers - salary and on-costs $150,000 per Officer, per annum

•  1 x Community Recovery Officers - operating costs $60,000 per Officer, per annum

•  Total program funding $210,000 per Officer, per annum

When reviewing the value of this opportunity for the community, local councils are asked to consider their ability to sustain up to four months of salary and operating costs for the initial period of the CRO program. The program works on a reimbursement model, where expenses will be reimbursed on a quarterly basis when the required documentation and evidence is submitted to the NSW Reconstruction Authority.

On-costs for eligible employee related expenses are claimable as per the table below, as it applies to the agency. These on-costs rates have been agreed between the Commonwealth and the State for the purpose of natural disaster claim under the Disaster Relief Account (DRA) and reviewed every financial year. NSW Reconstruction Authority understands that council may have oncost rates of up to 50%, however the CRO program is funded based on the below oncost table. The on-cost rate for the Community Recovery Officer Program allows the following elements/percentages to be claimed. Current maximum oncost rate is 33.19%. For a fixed term contract, you cannot claim long service leave.

It is expected that the CRO will have access to a council pool vehicle which will aid in the delivery of the program. Limited expenses are able to be claimed for the provision of this vehicle. If a council pool vehicle is not available for use, the CRO is able to hire a vehicle to attend recovery meetings, events or activities related to their duties.

That Local Government NSW call on the NSW Government to continue the work left by the previous government in respect of the demerger of Cootamundra-Gundagai Regional Council and have the demerger complete before the local government elections in September 2024.

Motion Background

The proposed demerger of Cootamundra-Gundagai Regional Council was the subject of Reports by the NSW Local Government Boundaries Commission (LGBC) dated 22 February 2021 and 27 July 2022. As a result of the NSW LGBC 27 July 2022 report, the then NSW Minister for Local Government approved the demerger of Cootamundra-Gundagai Regional Council in late August 2022.

Since the then Minister’s announcement, various studies were commissioned by the NSW Office of Local Government (OLG) and on 2 February 2023 a Demerger Roadmap was released by NSW OLG. With the advent of the NSW State election, a new NSW Government and a new Minister for Local Government, further direction on the demerger of Cootamundra-Gundagai Regional Council has not been forthcoming at the time of preparing this Motion.

Motion Background

The NSW Local Government Act 1993 was proclaimed in 1993 and has been in place for some 30 years. Over the years the Act has been amended at various times.

At the very least, it would seem appropriate that the Act be reviewed to ensure that the intent of the principles that drove the development of a new Local Government Act in 1993 have not been unnecessarily offended with the various amendments to the Act and that the Act remains fit for purpose as a governance framework for local government in NSW.

That Local Government NSW continues to lobby/advocate the Government by whatever means available to achieve an increase of Financial Assistance Grants to at least 1% of total Commonwealth taxation revenue.

Motion Background

Obviously, this is not new for local government. With a diminishing revenue base like most Councils in rural/regional NSW, the expectations of our communities continues to rise in contrast to our ability to satisfy these community expectations. Additionally, it is common for other levels of government to place additional responsibilities on local government without any corresponding allocation of resources.

An increase in the annual Financial Assistance Grants to 1% of Commonwealth taxation revenue would result in an injection of untied funding that would allow councils to maintain and renew infrastructure to required standards, provide essential services and respond to often valid requests for service levels expected by our communities. It is common knowledge that Financial Assistance Grants were originally introduced with a platform of 1.2% of personal income tax revenue, earmarked to increase to 2.0%. This has never occurred and in fact currently Financial Assistance Grants sits at around 0.5% of Commonwealth taxation revenue.

Discussion

To comply with Section 406 of the Local Government Act, 1993 and in accordance with the Office of Local Government’s Integrated Planning and Reporting guidelines ‘The general manager must ensure that regular progress reports are provided to the council, reporting as to its progress with respect to the principal activities detailed in its delivery’.

Accordingly, attached to this report is the quarterly progress report outlining the extent to which performance measures and targets, set out in the Delivery Program and Operational Plan, have been achieved during the fourth quarter of the reporting year; that is between 1 April – 30 June 2023.

The next progress report will be presented to Council at the Ordinary Meeting of Council to be held 28 November 2023 and will consist of status updates for actions within the 23/24 Operational Plan (1st quarter reporting period of July-Sept 2023).

A report on Council’s Investments is required to be presented for Council’s consideration in accordance with Clause 212 of the Local Government (General) Regulation 2021.

PRIOR TO COMMENCEMENT OF WORKS

(5)       PCW Condition – Prior to Building Work Commencing.

 

The erection of a building in accordance with the development consent must not commence until:-

 

1.    a construction Certificate for the building work has been issued by the consent authority, the council (if the council is not the consent authority) or an accredited certifier, and

 

2.    the person having the benefit of the development consent has:

a.    appointed a principal certifying authority for the building work, and

b.    notified the principal certifying authority that the person will carry out the building work as an owner-builder, if that is the case, and

 

3.    the principal certifying authority has, no later than 2 days before building works commences:

a.    notified the consent authority and the council (if the council is not the consent authority) of his or her appointment, and

b.    notified the person having the benefit of the development consent of any critical stage inspections and other inspections that are to be carried out in respect to the building work, and

 

4.    the person having the benefit of the development consent, if not carrying out the work as an owner-builder, has,

a.    appointed a principal contractor for the building work who must be the holder of a contractor licence if any residential work is involved, and

b.    notified the principal certifying authority of any such appointment, and

c.     unless that person is the principal contractor, notified the principal contractor of any critical stage inspection or other inspections that are to be carried out in respect of the building work.

 

Reason: To ensure compliance with the requirements of the Environmental Planning and Assessment Regulations.

 

(6)       PCW Condition – Signage.

 

Site signage shall apply and must be erected on the site in a prominent, visible position for the duration of the construction. The signage must include: -

 

1.    Statement that unauthorised entry to the site is not permitted

2.    Show the name of the builder or another person responsible for the site and a telephone number at which the builder or other person can be contacted outside working hours

3.    The name, address and telephone contact of the Principal Certifying Authority for the work

 

Any structures erected to meet the requirements of this condition must be removed when it is no longer required for the purpose for which it was erected.

 

Reason: To meet the minimum requirements of the Environmental Planning & Assessment Regulation.

 

(7)       PCW Condition – Notice of Commencement.

 

Prior to work commencing a ‘Notice of Commencement of Building Work and Appointment of Principal Certifying Authority’ shall be submitted to Council at least    2 days prior to work commencing.

 

Reason: To meet the minimum requirements of the Environmental Planning & Assessment Regulation.

 

(8)       PCW Condition – Builders Toilets.

 

Provision being made for temporary WC accommodation on site prior to the commencement of excavation or other associated building works.

 

Reason: To ensure minimum standards of hygiene for onsite workers.

 

(9)       PCW Condition – Residential Building Work.

 

Residential building work within the meaning of the Home Building Act 1989 must not be carried out unless the principal certifying authority for the development to which the work relates (not being the council) has given the council written notice of the following information

 

1.    In the case of work for which a principal contractor is required to be appointed:

a.    In the name and licence number of the principal contractor, and

b.    The name of the insurer by which the work is insured under Part 6 of that Act.

 

2.    In the case of work to be done by an owner-builder:

a.    The name of the owner-builder and,

b.    If the owner builder is required to hold an owner builder permit under the Act, the number of the owner-builder permits.

 

If arrangements for doing the residential building work are changed while the work is in progress so that the information notified under subclause (1) becomes out of date, further work must not be carried out unless the principal certifying authority for the development to which the work relates (not being the council) has given the council written notice of the updated information.

 

Reason: Statutory compliance.

 

(10)     PCW Condition – Siting of Building.

 

The applicant is responsible to ensure that the building is sited on the allotment and constructed to the design levels approved by Council as specified on the approved site plan.

 

Reason: To ensure the development is carried out on the correct allotment.

 

(11)     PCW Condition – Waste Storage During Construction.

 

Provision shall be made on site for the proper storage and disposal of waste such that no builders' waste shall be left in the open. Specific attention should be given to items which are subject to relocation by the action of wind, e.g. Paper, sheets of iron, ridge capping, cement and lime bags and the like.

 

Reason: To ensure that the site is not a source of wind-blown litter.

 

(12)     PCW Condition – Soil Erosion Control.

 

Site erosion control measures shall be incorporated into site management during construction. Seepage and surface water shall be collected and diverted clear of the building site by a drainage system. Care shall be taken to ensure that no nuisance is created to adjoining properties or public space by way of sediment run off.

 

Reason: To ensure that adequate measures are in place so that damage from sediment run off to adjoining sites and waterways is minimised.

 

(13)     PCW Condition – Second Hand Materials.

 

No second hand materials are to be used on any external surface of the building unless made available for inspection and separately approved by Council prior to erection.

 

Reason: To ensure the external appearance of the building is maintained to an acceptable standard.

 

(14)     PCW Condition – Underground Services.

 

The applicant shall locate and identify all existing underground services prior to commencement of works and ensure there shall be no conflict between the proposed development and existing infrastructure including areas external to the development site where works are proposed.

 

Reason: To ensure the utility services are protected and satisfactory for the proposed development.

 

DURING CONSTRUCTION

(15)     DUR Condition – Works to be undertaken in Accordance with the Approval.

 

All proposed works to be undertaken are to be carried out in accordance with the conditions of development consent, approved construction certificate drawings and specifications.

 

Reason: ensure all works are carried out in accordance with the development consent.

 

(16)     DUR Condition – Hours of Construction Site Works.

 

Construction site works including the entering and leaving of vehicles is limited to the following hours, unless otherwise permitted by Council:-

 

Monday to Saturday from 7.00am to 7.00pm

Sundays and public holidays from 9.00am to 12.00pm

 

The applicant is responsible to instruct and control subcontractors regarding hours of work.

 

Reason: So that the development does not reduce the amenity of the area.

 

(17)     DUR Condition – Footpath Storage.

 

Building materials not to be stored on Council footway or nature strip at any time.

 

Reason: To ensure an adequate level of public safety is maintained.

 

(18)     DUR Condition – Waste Removal.

 

All debris and any waste fill are to be removed from the site and disposed of at an approved, licensed waste facility. Please note that a separate fee applies for disposal of waste at Council's waste depots. You should contact Council for an estimate of costs in this regard or refer to Council’s adopted Fees and Charges.

 

Reason: To ensure that the amenity and unsightly condition is minimised.

 

(19)     DUR Condition - BCA Compliance.

 

All building work (other than work relating to the erection of a temporary building) must be carried out in accordance with the requirements of the Building Code of Australia (as in force on the date the application for the relevant construction certificate was made). 

 

Reason: To ensure the building complies with the BCA.

 

(20)     DUR Condition – Inspections.

 

The Principal Certifying Authority is to be given a minimum of 48 hours’ notice prior to any critical stage inspection or any other inspection nominated by the Principal Certifying Authority via the notice issued under Section 58 of the Environmental Planning and Assessment (Development Certification and Fire Safety) Regulation 2021.

 

All building work (other than work relating to the erection of a temporary building) must be carried out in accordance with the requirements of the Building Code of Australia (as in force on the date the application for the relevant construction certificate was made). 

 

Reason: To ensure that adequate time is given of required inspections.

 

(21)     DUR Condition – Restricted Public Access.

 

It is the responsibility of the applicant to restrict public access to the building site, building works or materials or equipment on the site when building work is not in progress or the site is otherwise unoccupied in accordance with SafeWork NSW Regulations.

 

Reason: To ensure public safety is maintained.

 

(22)     DUR Condition – Storm Water.

 

Storm water is to be discharged: -

 

1.    To the roadside gutter, taken through the kerb and the kerb is to be made good or, alternatively, linked to existing storm water drainage which discharges at the roadside gutter

 

Reason: To ensure that roof water is disposed of without nuisance to neighbours, without overloading Council's laneways system and so as to minimise input to the ground water system

 

(23)     DUR Condition – Storm Water / Ground Water Diversion.

 

Run-off and ground water seepage shall be diverted around the building to the storm water system via a suitable ag drain or dish drain.

 

Reason: To minimise the opportunity for ponding and flooding.

POST CONSTRUCTION

(24)     POC Condition – Occupation of Building.

 

A person must not commence occupation or use of the whole or any part of the buildings unless an occupation certificate has been issued by the appointed Principal Certifying Authority.

 

Reason: So that the development is substantially completed to a safe standard to allow use or occupation of said building.

 

ONGOING USE

(25)     USE Condition – Business Use.

 

The shed not being let, adapted or used for separate occupation or commercial purposes.

 

Reason: Development consent is required for any activity other than residential.

 

(26)     USE Condition – Clean and Tidy.

 

The premises are to be maintained in a clean and tidy condition at all times.

 

Reason: So that the development does not reduce the amenity of the area.

 

 

(27)     USE Condition –Amenity General.

 

The development is to be conducted in a manner that will not interfere with the amenity of the locality by reason of the emission of noise, vibration, smell, fumes, smoke, vapour, steam, soot, ash, dust, waste water, waste products, grit, oil, by causing interference to television or radio reception or otherwise.

 

Reason: So that the development does not reduce the amenity of the area.

 

(28)     USE Condition – Non Habitable Use.

 

The shed is not to be used for residential occupation without prior consent of Council.

 

Reason: Health and safety prohibition.

SPECIAL CONDITIONS - ATTACHMENT A (Essential Energy)

1.         Essential Energy’s records indicate existing LV overhead powerlines (laneway) are impacted by the proposal:

 

a.         The proposed shed (closest part – eaves, guttering) must maintain a minimum clearance of 2.945 metres (horizontally) from the nearest conductor.

b.         Minimum safety clearance requirements are to be maintained at all times for any proposed driveway access and/or exit (concrete crossovers), as such driveway access will pass under Essential Energy’s existing overhead powerlines located on the laneway frontage of the property. The driveway must comply with clearances for trafficable land, ground clearances must be maintained. Refer Essential Energy’s policy CEOM7106.25 Minimum Clearance Requirements for NSW and the latest industry guideline currently known as ISSC 20 Guideline for the Management of Activities within Electricity Easements and Close to Infrastructure.

c.         Any proposed driveway access and/or exit (concrete crossovers) must remain at least 1.0 metre away from any electricity infrastructure (power pole, streetlight) at all times, to prevent accidental damage.

d.         Any excavation works in this area or works on any proposed driveway must comply with ISSC 20 Guideline for the Management of Activities within Electricity Easements and Close to Infrastructure.

e.         Any landscaping, tree planting, gardens, fencing in this area must comply with ISSC 20 Guideline for the Management of Activities within Electricity Easements and Close to Infrastructure.

 

2.         If required, the Applicant will need to engage the services of an Accredited Service Provider to ensure adequate provision of power is available to the proposed shed in accordance with NSW Service and Installation Rules. A Level 2 Electrician will be able to advise on these requirements and carry out the required work to ensure compliance.

 

3.         The existing overhead service connecting the adjoining property (at the rear) will also need to comply with the NSW Service and Installation Rules, in particular to clearances to the proposed shed.. This may mean that this existing service will need to be re-located, at the Applicant’s expense. A Level 2 Electrician will be able to advise on these requirements and carry out the required work to ensure compliance.

 

Essential Energy also makes the following general comments:

1.         If the proposed development changes, there may be potential safety risks and it is recommended that Essential Energy is consulted for further comment.

2.         Any existing encumbrances in favour of Essential Energy (or its predecessors) noted on the title of the above property should be complied with.

3.         In addition, Essential Energy’s records indicate there is overhead electricity infrastructure located within the property and within close proximity of the property. Any activities within this location must be undertaken in accordance with ISSC 20 Guideline for the Management of Activities within Electricity Easements and Close to Infrastructure. Approval may be required from Essential Energy should activities within the property encroach on the electricity infrastructure.

4.         Prior to carrying out any works, a “Dial Before You Dig” enquiry should be undertaken in accordance with the requirements of Part 5E (Protection of Underground Electricity Power Lines) of the Electricity Supply Act 1995 (NSW).

5.         Given there is electricity infrastructure in the area, it is the responsibility of the person/s completing any works around powerlines to understand their safety responsibilities. SafeWork NSW (www.safework.nsw.gov.au) has publications that provide guidance when working close to electricity infrastructure. These include the Code of Practice – Work near Overhead Power Lines/Underground Assets.

Introduction

This report assesses a development application (DA2023/32), for the construction of a new 80m2 storage Shed on Lot A DP 414532, 79 Hurley Street Cootamundra.

The application is referred to full Council for determination, as the application seeks a variation to the Cootamundra Development Control Plan 2013, having a proposed floor area 14.3% above the development standard of 70m2.

Discussion

The assessment of the application has considered all relevant matters under Section 4.15 of the Environmental Planning and Assessment Act 1979 (the Act) and the requirements of the Cootamundra DCP 2013.

The Shed is proposed to be constructed in the rear yard of 79 Hurley Street, 1 metre off the NE side and rear boundary. The Lot is 797m2, and the development standard for a lot of that size is 70m2. Council staff have delegation to consider 10% variations to this standard, however the shed – at 80m2 – is 14.3%. 

The development assessment concludes that the overall design of the development would be appropriate in the context of the area and the streetscape, and the proposed variation is considered reasonable. See development assessment report (Attachment 1).

Introduction

The CGRC Engineering Report for the month of August 2023 is submitted for the information of Council and the community.

Discussion

Fixing Local Roads

 

Work in French Street, Cootamundra has seen the installation of the new kerb and gutter down both sides.  The road pavement was due to commence in the third week of August, which will see the existing pavement reshaped with some additional road base and then stabilised. While these works are underway, residents have been advised that they will have limited access to their properties.

Work also continues on Brawlin Road, Brawlin with culvert installation still continuing. Some 9 culverts have now been replaced across the road with 2 left to finish the drainage works. Once all drainage culverts have been installed, works will be scheduled on the road pavement rehabilitation.

The Old Gundagai Road project which is halfway between Muttama Road and Rosehill Road had seen the culvert extension completed at the end of July. At the time of writing the road pavement is being reshaped with pavement stabilisation underway. This project will see 1.2km of poorly pavement reshaped and rehabilitated to improve its geometry and ride quality.

 


 

Regional and Local Roads Repair Program Funding (RLRRP)

 

As part of the identified work in the RLRRP program, heavy patching works are underway on Brungle Road, Brungle progressively being sealed as the works progress.

 

As part of the identified work in the RLRRP program, initial works on Dirnaseer Road (Frampton area) and Muttama Road near Old Gundagai Road along with works on Rosehill, Jugiong and Old Gundagai Roads have now all been sealed. This completes the expected works identified in the Cootamundra area.

 

Regional Roads REPAIR Program

 

The Regional Roads Repair program on West Street, Gundagai has been completed for 2022-2023 financial year. Line marking will be completed on West Street in coming weeks under the Regional Roads maintenance.  The repair funding for 2023-2024 financial year, intended for the next stage of West Street, has been delayed for a further 4-6 weeks by the NSW government.

 

Local Roads and Community Infrastructure Program (LRCI)

 

Footpath works will be commencing in the coming months on Hanley Street and West Street, Gundagai as prioritised under the LRCI program. Funding for Round 4 and a supplementary round has recently been announced, with proposed projects being determined for Council consideration at a future Council Meeting.

 

The footpath replacement in front of the Cootamundra High School, Poole Street and the Footpath along Bourke Street between Thompson and Hovell Street, Cootamundra have both been completed. These paths, identified in the PAMPS program, were identified due to their high usage being in front of the High School and the main link from the Railway Station to the Cootamundra CBD.

 

Natural Disaster Repairs

 

Works have commenced on outstanding significant roads maintenance projects from the January 2021, AGRN1001 event including isolated pavement repairs and tree works throughout the Council region.

 

State Highways

 

The shoulder widening works on the Olympic Highway south of Cootamundra near Frampton Road is now awaiting the installation of guard rail which is subject to contractor availability. 

Additional shoulder widening, along with culvert widening, has now commenced between Old Gundagai Road and Wallendbeen.

All the above works are part of reducing roadside hazards and safety improvements to motorists on the State Highways.


 

General works

 

Patching crews are once again working hard repairing bitumen roads throughout the Council area and endeavouring to maintain their condition through the winter period. Maintenance grading has been completed in the Nangus region on Yabtree Road and Lucerndale Road continuing onto Wee Jasper Road.

 

Water and Sewer

 

Crews have attended to water main breaks and sewer chokes as required.

 

The Royal Well Pump Station project is close to completion. Final site preparation and electrical componentry is underway in preparation for commissioning.

 

The request for tendering the investigation and design of the replacement sewer rising main from the Betts Street Sewer Pump Station to the Treatment Plant in Cootamundra is currently being advertised. A recommendation is now expected to be put to the September Council Meeting. 

The preparation of tenders for the replacement of several sections of water main in the Cootamundra township is nearing the advertising stage. Council currently has funds for both these capital works in the current budget with physical works expected during this financial year.

Introduction

The Regional Services Gundagai works report for July 2023 provides a detailed update on works activities undertaken by the regional Services Team. The scheduled activities and projects undertake for August 2023 are included in this report which has been prepared and submitted for the information of Council and the community.

Discussion

It has been a busy time in our Biosecurity section with staff attending training at Goulburn for the 3.5 Day Weeds Induction Program 2023, continuing to grow their knowledge in this area.

Regional Services staff have this month received their certificate of accreditation for Prohibited Weeds, after their attendance at last month course.

Growing our knowledge base and working with LLS and DPI is being of huge benefit to Council and our staff.

Our 22/23 final WAP funding submission has been submitted with CGRC being only the second Council to have their submission completed. Unfortunately, due to circumstances beyond the control of the current Regional Services Teams the 22/23 WAP funding requirements were not fulfilled, and this has led to an adjustment in our WAP funding for that year.

After much work and communication with our Regional Weeds Coordinator, we have been able to contribute our unexpended 22/23 funds to our region thus retaining our full allocation for the current financial WAP funding.

Our Regional Services team have already made a start on completing some of our assigned tasks for our WAP funding by hosting a weeds table in conjunction with Local Government week. This was very well received by the community with our information packs being scooped up. These contained the current version of the Priority Weeds booklets, the DPI NSW Weed Control Handbook with control techniques, chemical mixing rates etc, flyers containing information for eradication of prominent grasses in our area such as African lovegrass, Chilean needle grass and Coolatai grass.

Our team has also taken on the task of providing LLS with weeds from our region to display at the Henty Machine Field Days. The HMFD is Southern Australia’s single biggest agricultural event, the message, “TALK TO US ABOUT WEED MANAGEMENT” this will also contribute to completing another component of our 23/24 WAP funding.

Along with our additional activities our normal weed control continues with our chem certified staff covering this area in the absence of a weeds officer with the spraying of town street and surrounding areas.

It is to be highlighted that the output of work being covered and the willingness of staff from our P&G team, regulatory and ranger to work together to achieve the best outcome for Council and our community across all Regional Services areas is to be commended. They have come together as a whole and have crossed over to cover duties that may not generally fall withing their purview.

It has been wonderful to hear so many positive comments coming through our front counter about our staff and the work they have undertaken to maintain our park and gardens, streets, public toilets etc.

They have undertaken the trimming of the gardens and plants around the area, trimming back of trees and plants the protrude across our footpaths. Repairs to our RV parks from wet weather damage have been ongoing due to the winter weather and popularity of our RV parks.

The Regional Services team have also conducted works at the Common and Golf Course to repair the fencing, changed banners in the main street, cleaned and maintained all 10 cemeteries to the highest standard and completed all their general duties.

Our ranger services have been kept busy with several reports regarding roaming stock on the road, several dog attacks, lost companions whose owners have been located and a couple of rehoming’s. We have removed three abandoned vehicles from our streets under the new Public Spaces Act. Our Regional Services Team also held a Companion Animal Table at the Local Government Week distributing free information on registration, animal care, keeping animals etc. We had some great give aways of collars, CGRC leads and dog treats. This was a great way to promote Council services.

 

Sadly, as it seems to be with the colder weather, we have had an increase in burials across our cemeteries. With this, come the flow on effect of an increase in plaque and head stone orders and affixing and monument erections in our monumental sections.

Sherwood Forest – As stage 1 has now been completed, we have taken delivery of the news trees and shrubs that will take their place and start to form the new Sherwood Forest precinct. Contractors have been engaged to carry out final shaping of the site and grinding of the remaining stumps, before starting planting works.

Gundagai Swimming Pool - works to fix the major crack in the pool have now been completed in readiness for the upcoming season.

Gundagai Netball and Youth Space – The electricity meter has now been installed and power connected.

Muttama Hall Supper Room – The kitchen has been installed and job completed.

Lindley Park – The electricity meter has been installed and power has been connected.

Financial

Works have been undertaken via the approved 2023/24 budget.

Introduction

This report outlines the Regional Services Cootamundra Departments routine field work activities and Capital Work Programs progress for the month of July 2023.

Discussion

Cootamundra Parks & Gardens Section

Works have consisted in most part of mowing, garden bed rejuvenation and maintaining the urban and village public open spaces, gardens, and associated facilities.

Cootamundra Sportsfield Unit

Routine Maintenance works have continued with preparation in getting ready to commence the control of broadleaf control, in an attempt to minimise mowing.

Street Trees

Council has commenced working on the back log of customer inquiries relating to street tree maintenance. Essential Energy has commenced tree pruning under power lines. This has not got off to a good start with Council having to meet with power authority contractors regarding the very poor manner in the way they are pruning Council trees, and lack of consultation.

Cootamundra Public Facilities Unit

Staff are carrying out the routine maintenance of Council’s open space facilities e.g., public toilets, BBQ’s, playgrounds etc.


 

Cootamundra Recreation Section

As a result of inspections of the Pool and Stadium been held over the past month as to determine the level of maintenance on operation equipment required for the upcoming swimming season. Works have commenced in undertaking related maintenance works based on priorities.

Noxious Weeds

A substantial amount of work has been undertaken in coming to understand Councils requirements relating to managing Biosecurity throughout the Cootamundra Area. Staff are being upskilled and works undertaken to engage a Bio Security Officer.

Regulatory/Compliance Services.

The department continues to assess past and current regulatory practices relating to the issuing of fines as to ensure fair practices and policy/regulation procedures are implemented when assessing each and every situation.

Cemeteries

Normal cemetery inquiries and procedures are being implemented with few issues arising.

Cootamundra Saleyards

Basic maintenance works continue with a strong focus on improving the operation of the truck wash.

Landfill/Transfer Station Operations Unit

Day to day operations continue, with shredding of green waste stockpiles currently underway. Including in this is the sieving of existing compost piles as part of the continuing composting operations.
