Introduction
At the Ordinary Meeting on 22 May 2018 Council resolved that the Draft 2018/19 Operational Plan (incorporating Revenue Policy, Fees & Charges and budget) and draft 2018/19-2020/21 Delivery Program and Long Term Financial Plan, be placed on public exhibition in accordance with the Community Engagement Strategy for not less than 28 days, from 23 May 2018 to 19 June 2018 inviting submissions from the public.
Discussion
The notice of public exhibition and invitation for submissions was duly advertised as follows:
· The Cootamundra Herald Snippets on 25 May and 6 June 2018
· Fortnightly newsletter week commencing 25 May and 8 June 2018
· Council’s Website and Facebook pages
· Copies made available at the Council Administration Centres and Libraries
including advice that all submissions must be lodged by 5pm 19 June 2018.
In response to the public exhibition process, 13 submissions were received at the time this report was created and are attached. The submissions were acknowledged and reviewed. The key points raised in the submissions are documented below with respective comments provided in response.
SUBMISSIONS
1. From Julie Cowell, Office Coordinator, The Arts Centre Cootamundra (TACC) dated 29 May 2018:
Comment: Where other properties have been mentioned (libraries and Gundagai visitor centre repeatedly) TACC is conspicuously absent in parts 1.1b (1&2) of the Delivery Program.
Response: Libraries and Visitor Information Centres are not specifically referred to in the subject sections but do appear as appropriate throughout the document. Part 1.1b refers to art and cultural bodies of which TACC is a key organisation.
Comment: 1.1c (1) of the Delivery Program - How is the best interests of volunteers to be managed? TACC volunteers have never been acknowledged by Council at any volunteers days.
Response: This is not considered to be a specific Deliver Program issue but, notwithstanding, the vital importance of volunteers and the valuable contribution they make to the wellbeing of the community is recognised and acknowledged.
Comment: 1.1d (2) of the Delivery Program - TACC infrastructure should be included here? Yes?
Response: As a Council owned local historical building, although not individually listed along with other such buildings, the TACC Building is covered by this item.
Comment: 1.1e of the Deliver Program - inclusive practise which TACC is pushing through the partnership with Murmuration and professional development programs. The centre desperately needs a ramp emergency exit from the theatre area.
Response: The ramp emergency exit is include for funding through the draft 2018/19 Operational Plan. Council has assisted TACC with various funding applications and once funding approval is granted for this project it can be included on an appropriate works program.
Comment: 2.1a (1) of the Deliver Program - Interesting concept to now try to integrate the Gundagai Coota region when there are two different tourism economic development officers, one of whom has NO interest in the Cootamundra area. Would have thought that the first step to this would be to have a single tourism economic development officer who could bring the two together.
Response: Following the forthcoming consideration of Council’s structure, the structure of Council’s Economic Development Section will also be reviewed.
Comment: 2.1f (2) of the Delivery Program - Developing collaborative events which was an area that could have been covered by the Cootamundra Development corporation, but does not happen. All this regions events and assets need to be managed collaboratively to value add for visitors and to reduce work load on volunteers if events are centrally managed to best market and bring people to the area.
Response: A number of initiatives are being planned including the development of a tourism website and social media channels to provide coverage of the entire Local Government Area. These initiatives are outlined in the service unit plan.
Comment: 2.3 a & b of the Delivery Program - TACC again not mentioned.
Response: No specific organisation or service delivery outlet is provided in this section. However it is acknowledged that it is intended that TACC is, and continues to be considered a key component of this strategy.
Comment: 2.3c (1) - upkeep visitor centres - Cootamundra barely has one (and no offense to the historical society and heritage centre who work their butts off to keep the place open), there is no update of brochures, there is little knowledge of local sights and no training in tourism. Unbelievable that Gundagai has a scheduled upgrade for the well-resourced and paid staff, and Coota misses out again.
Response: A proposed infrastructure upgrade to modernise and meet disability access requirements was developed in 2014 and is included in committed funds in the Merger Implementation funding. It is intended that a Tourism and Economic Development Strategy be completed in 2018/19 which is to include a needs analysis of the upgrading of other visitor services infrastructure.
Comment: 3.1d - would like to see an increase in recycling capabilities and push for residents to do it - food waste, soft plastics and especially glass.
Kurrajong recyclers in Wagga recycle glass that cannot be re-melted, into builders aggregate and sand for all sorts of purposes (including horse working areas) - this is a great way to stop taking sand out of our river banks and use glass that would otherwise end up in landfill.
Response: Council’s ideal is for increased recycling across all varieties of waste. Unfortunately materials recovered from recycling processes are commodities that rely on market prices to be viable. Under the current arrangements all recycled materials recovered at the Cootamundra MRF are the property of Elouera and they determine what is recyclable locally, and how the materials are handled and traded.
In regards to food waste, Council will be incorporating food waste collection into the current garden organic collection in the Cootamundra area in spring this year. Gundagai already has a food and organics collection. This will result in a reduction in the amount of food waste in the current red bin kerbside collection in Cootamundra, Stockinbingal and Wallendbeen.
Glass recycling is also determined by market fluctuations and while Kurrajong does recycle glass into a high grade product, it finds it hard to resell the glass product produced. In fact, as with many of the glass recyclers in NSW, Kurrajong currently has a large stockpile of the material that it finds hard to move. In Council’s case, it is the cost of transportation that is the limiting factor in purchasing and using more of the recycled glass product.
It is planned that Council will increase its waste education and advertising across all areas of waste from July this year in preparation for, and in conjunction with, the introduction of the new food and organics service.
Comment: Pages 13-19 of the Operational Plan - no mention of any ongoing support for TACC by way of infrastructure maintenance or operational funding.
Response: The sections referred to include Capital Projects and the funding of Major Projects and it is confirmed that TACC is not included in these section for 2018/19.
Comment: The volunteers who built TACC always planned for the building to house events and gatherings that would increase tourism and have an impact on Economic development of the area, but there is no mention of TACC being a part of that in the region (page 33 of the plan).
Response: The subject page includes projects that Council staff will be undertaking during the term of the Operational Plan. Some of these projects are likely to involve TACC. TACC has not traditionally sought Council approval for its various activities proposed for the forthcoming year. However, as a Section 355 Committee, inclusion of its projects in the Operational Plan could be considered as an option for the future.
2. From David Sharp, Director – Advisory & Consulting, Generate Pty Ltd dated 1 June 2018:
Comment: In support of The Arts Centre Cootamundra’s application for an increased financial contribution from Council.
Response: Noted.
3. Submission Three dated 5 June 2018:
Comment: My concern is a seemingly imbalance of available funding between the two areas of the Council Region with Gundagai area patching up works that were clearly not done under its old Shire Council and receiving funding for projects where multinational or organized community groups could source grant funding for community enterprise.
Response: The Delivery Program and Operational Plan is based on the outcomes of consultation that informed Council’s Community Strategic Plan, with expenditure proposed in the Operational Plan prioritised in consideration of available resources and competing demands.
Comment: Why spend money on upgrading an existing VIC in Gundagai when Coota does not even have one that is supported by professional staff or really active?
Response: A proposed infrastructure upgrade to modernise and meet disability access requirements was developed in 2014 and is included in committed funds in the Merger Implementation funding. It is intended that a Tourism and Economic Development Strategy be completed in 2018/19 which is to include a needs analysis of the upgrading of other visitor services infrastructure.
Comment: Why are we spending so much on "Library" Services as economic development strategies when these are a Council service not economic growth generators.
Response: The Delivery Program and Operational Plan is based on the outcomes of consultation that informed Council’s Community Strategic Plan, with expenditure proposed in the Operational Plan prioritised in consideration of available resources and competing demands.
Comment: What is it that is enduring the world over? What is it that makes a place unique and sets it apart the world over? It is its unique landforms and its ARTS & CULTURE. It seems CGRC planning does not recognize the importance of either agricultural enterprise or the The Arts Centre in ability to generate economic growth and spread health and welfare benefits for all demographics within our Council Region.
Response: Council fully recognises and acknowledges the vital importance of agricultural enterprise and the Arts, in addition to the plethora of activities, organisations, and economic and cultural drivers that make the Cootamundra-Gundagai area a liveable and desirable location to reside.
4. Submission Four dated 5 June 2018:
Comment: Tourism: Cootamundra needs a designated VIC with professional staff to do the work of seeking enterprise and developing programs. Spending valuable funds on Gundagai upgrade creates more of an uneven playing field between the two areas of the Council region. The Visitors are different, want different info and travel different routes requiring different info and support. Allocate funds to balance this inequity and increase tourist activity throughout the region. BULID A VIC IN COOTA BEFORE UPGRADING GUNDAGAI or do both if funding allows.
Comment: After giving 16 years of my life to building an Arts Facility that is unique and sets our town or region aside I am extremely disappointed CGRC do not value the massive hours community volunteers put in to facilitate this initiative for the Shire. As a business man I find it difficult to understand the lack of financial understanding about what is economic development.
Response: Council fully understands and sincerely appreciates the enormous contribution in time, skills, knowledge and commitment that TACC volunteers, and all volunteers in the region, make to the social fabric of our communities. However, in terms of financial contributions to individual organisations, The Delivery Program and Operational Plan is based on the outcomes of consultation that informed Council’s Community Strategic Plan, with expenditure proposed in the Operational Plan prioritised in consideration of available resources and competing demands.
5. From Louise Herron, CEO Sydney Opera House dated 6 June 2018:
Comment: In support of the Arts Centre Cootamundra to secure an ongoing operational funding contribution from Council.
Response: Noted.
6. From Lindsey and Andrew Baber dated 12 June 2018:
Comment: Expressing concern regarding inadequate funding being allocated to TACC.
Response: Noted.
7. CEO of Regional Arts NSW Elizabeth Rogers dated 8 June 2018:
Comment: In support of The Arts Centre Cootamundra’s (TACC) for request for financial support from Council.
Response: Noted.
8. Submission Eight dated 14 June 2018:
Comment: Expressing concern that the current Draft Operational Plan makes no mention of the on-going needs of The Arts Centre Cootamundra and requests that Council review their Draft Plan with a view to incorporating the future needs of the Arts Centre, Cootamundra.
Response: Noted.
9. From Anne Steinke dated 18 June 2018:
Comment: Expressing concern that the DP and OP does not appear to be considering how the council will offer support to The Art Centre Cootamundra into the future.
Response: Noted.
10. From Brian Halstead, President, Save Our Councils Coalition (SOCC) dated 18 June 2018:
Comment: Request for Council to detail the amalgamation cost and savings over the period from amalgamation to 2021/22 compared to the proposal and include the full cost of IT changes and services and wages equalisation costs. An initial review shows a deficit of $1.9 million in the 18/19 year compared with the smaller deficit of $1.2million for the two councils in the 14/15 year prior to amalgamation, Council should inform the community in this plan the reasons why the amalgamated council is apparently doing financially less well that the two separate councils and what can be done to address the situation.
Response: The reporting standards required of Council can, on occasions, produce ‘headline’ results that benefit from explanation of how they are derived. The budgeted operating deficit of approximately $1.9m includes $8m in depreciation, while excluding income from capital grants of nearly $14m. Aside from the obligation to present this figure on that basis, councils typically present the budgeted operating result excluding depreciation as it is a non-cash expense, which leaves a budgeted surplus of approximately $6.1m.
11. From Sarah Last, Wired Lab dated 19 June 2018:
Comment: Letter of support towards the CGRC revising its Draft Operational Plan to include a financial contribution to the operation of the Arts Centre Cootamundra (TACC).
Response: Noted.
12. From Elise Magrath, Cultural Development Office, The Arts Centre Cootamundra (TACC) dated 19 June 2018:
Comment: Letter requesting that CGRC review its Draft Operational Plan currently on display to include a financial contribution to The Arts Centre Cootamundra (TACC) in an amount of $50 000 in the 2018 - 2019 financial year.
Response: Noted.
13. From Laurence Byron dated 19 June 2018:
Comment: The main focus of this submission is that Gundagai has a Dysfunctional Stormwater System and that this creates at significant infrastructure backlog that is not identified in the Operational or Delivery Plan.
Response: In view of the volume of the submission and the numerous issues raised a detailed response is unable to be prepared prior to publication of the business paper and commencement of the Council meeting. The full submission has been circulated to Councillors separately.
End of submissions.
It should be noted that the Asset Management Plan and Workforce Management Plan are also components of the Delivery Program and draft versions of these Plans are nearing completion. It is intended that the draft Asset Management Plan be the subject of a Councillor Workshop in July, following which the draft Plans will be submitted to Council for endorsement for Public Exhibition. Following public exhibition the Plans will then be considered by Council, in conjunction with any submissions, for adoption.

Introduction
Section 535 of the Local Government Act 1993 requires that rates and charges must be made by resolution of Council.
Discussion
The provisions of Section 532 of the Local Government Act 1993 specify that a council must not make a rate or charge until it has given public notice (in accordance with Section 405(3)) of its Draft Operational Plan for the year for which the rate or charge is to be made and has considered any matters concerning the Draft Operational Plan (in accordance with Section 405(5)).
Council has fulfilled the public notice obligation and the rates and charges
for 2018-19
must be made by resolution of Council. The recommendation of this report is
based on the
Operational Plan which it is anticipated will be adopted by Council at this
June Ordinary Meeting of Council.
In accordance with the Proclamation relating to the creation of Cootamundra-Gundagai Regional Council and the Local Government Amendment (Rates—Merged Council Areas) Bill 2017, a 4-year rate path freeze applies to Council from 2016/17 (until the end of the 2019/20 rating year). Therefore:
· The two rating structures adopted by the former Cootamundra and Gundagai Shires as at 12 May 2016, will continue to apply for that four year period.
· The ratio of rates
collected from each of the former Local Government Areas will be
retained for that four year period.
· The ratio of rates
collected from each of the rating categories and sub-categories
adopted by the former Councils will be retained for that four year period.
· The Special Rate Variation previously approved for the former Gundagai Shire Council will continue to apply to that former Council area.
The
Independent Pricing and Regulatory Tribunal (IPART) has determined that
Council’s
general income may be increased by 2.3% under Section 506 of the Local
Government
Act, 1993 for the rating year commencing 1 July, 2018. This increase has
been applied to
the notional rate incomes of each of the former Councils.
Where
applicable, the land to which each rate relates is indicated on the maps within
the adopted 2018-19 Operational Plan.

1. 2017-18 Works Program - June ⇩ |
The June Operations Update report be received |
Introduction
This report provides a detailed update of the Operations Department’s works for the month of June.
Discussion
Civil Works Section
Work on the Three Ways bridge project has seen the roadway sealed and reopened to traffic on 17th May. While the road is now open, new guard rail on the bridge approaches is yet to be installed. The installation will occur when a suitable contractor is available to undertake the work.
Stabilisation works have now been completed on Muttama Road near the old council boundary on Brawlin Hill. These works were a combination of works undertaken through the Regional Road Repair program and regional road heavy patching. Sealing of the works near the old boundary were hampered by rain and had to be rescheduled twice. Both these projects are yet to be line marked and guide posted, which will occur as soon as practical.
Line marking has been completed on Muttama, Nangus, Old Cootamundra and Rosehill Roads, and Temora Street as well as resealed areas. Several pedestrian crossing in Cootamundra were also remarked. This work has now reduced the backlog of line marking projects around the area; however, some still remain and will be completed when the weather warms up again.
A section of kerb and gutter has been replaced in Ursula Street between Hurley Street and Southee Circle. This section of kerb had been prioritised for replacement due to its poor condition and issues with water ponding.
Work is about to commence on replacing the damaged shared pathway along Boundary Road between Hurley Street and Sheahan Street. The old bitumen sealed path has deteriorated due to the ingression of grass into the sides of the bitumen and areas of subsidence. This project is part of the Stronger Communities funds listed for footpath repairs.
Culverts have now been placed in Pinkerton Road just east of the railway crossing. These culverts were installed to fill in the open channel and improve the drainage along this area. Final concrete works on the pit structures in still underway.
Further flood restoration works have been undertaken on Berthong Road and Beggan Beggan Road. This work includes culvert replacement and drainage works.
Maintenance grading has been undertaken on roads around the Tumblong area. Crews are now in the Coolac and Jugiong areas and will progress around the roads in those areas in the coming weeks. Bitumen shire road maintenance including patching has been undertaken as required around the bitumen road network.
The Gundagai works crew have commenced earthworks on the upgrade of the Gundagai Sewer Treatment plant starting with the access road.
Technical Services Section
The Stockinbingal rehabilitation work on the Burley Griffin way is nearing completion and is expected to be completed by the end of June. Most of the work has been primer sealed. At the time of writing this report the remainder was expected to be sealed by weeks end 22nd June. This includes the parking area into the old railway station. Replacement of guard rail is currently underway and should also be completed by end June. This work was being fully funded by the Roads and Maritime Service.
Saleyards
Awaiting confirmation from Essential Energy regarding lighting upgrades with expectations that the contractor can commence in late July. Revised options for quotes are currently being chasing up for the biological reactor tanks to treat the effluent system.
Maintenance staff repaired the seat in front of the Cootamundra Saleyards office by removing the old timber slats and replacing them with hardwood slats.
A works program is attached which details the expected works for the next six week. The new 2018/2019 program will be presented to the July Ordinary Meeting of Council meeting following adoption of the funding for next year’s works.
Parks & Gardens
Cootamundra Parks and Gardens staff have installed the new sign for the Visitors Information Centre (VIC). The VIC is located within the Heritage Centre building located in Hovell Street, Cootamundra.
One of the concrete steps on the Fisher Park Grandstand had been smashed by vandals and a new step has been fitted to ensure safe access to the top levels. The Grandstand was also pressure washed in readiness for the Rugby League home game on the weekend. Clarke Oval was marked prior to the Australian Rules home game the same weekend.
The baby swing seat at Jubilee Park was damaged and had to be replaced. Maintenance was also carried out on the fitness equipment within Gordon Vesperman Park.
The gravel road used to access Pioneer Park had a very large washout section that Parks and Gardens staff have filled with gravel to make the area safe. Maintenance grading will be carried out when weather and resources permit.
Fences damaged due to fallen trees have been repaired by contractors at both the old Ampol site and Riding for the Disabled boundaries.
Work has continued with trimming of vegetation growing over laneways enabling better access for property owners and garbage trucks.
With the high volume of autumn leaves falling around town combined with the wet weather, staff have spent extra time blowing down the footpaths around Cootamundra.
A specialist consultant has been engaged to conduct a Tree Audit over the next few months. The audit will assess overall condition of Council trees within the town limits of Cootamundra and Gundagai. As a result, of the initial stage of this audit, staff have removed some trees which were deemed to be of high risk by the contractor.
The Gundagai Parks and Gardens staff recently completed an upgrade to the Friendship Park playground surfacing. The existing sand playground surface at the park was cleaned of weeds and other matter then loosened prior to the addition of playground soft fall mulch to the entire fenced playground area.
The Gundagai Parks and Gardens staff have completed a clean-up of the RV camping site on Morley’s Creek. The trees in the area were under pruned so as to allow improved access for campers and mowing equipment. Whilst undertaking the work the team identified a European Wasp nest which was located in the creek bank. The nest was treated and then destroyed.
Swimming Pools
Maintenance on the Cootamundra outdoor pool grounds, pumping and filtration equipment is currently being carried out by staff. These works will see the pools be prepared and ready for upcoming 2018/2019 summer swimming season.
Installation of the shade sail structures at the Cootamundra Swimming Pool was completed. The new structures provide shelter to both ends of the 50 metre pool and over a section of the toddler pool.
An Expression of Interest for the operation of the Gundagai Pool Gym Room was advertised from May 4 to May 17 and submissions closed on May 17. During this period Council received enquiries from two interested parties. At the closing of the submission Council had only received one application for the operation of the room and a new agreement, which will commence on July 1, is currently being finalised with the successful applicant.
Property and Building Maintenance
The toilets at Depot 1 were painted and the leaking taps were fixed.
Two new seats were installed out the front of the Cootamundra Council Office in Cooper Street. New seat slats were installed on the seat along the bird walk along Muttama Creek.
Staff are undertaking painting of the new Owen Vincent Oval amenities building prior to its planned opening on 22nd July, 2018.
Stockinbingal Hall’s external locks were replaced with new fittings. The renewal of the locks will give the Stockinbingal Hall users improved access to the building.
The Town Hall is being prepared prior to a fundraising ball booked in for 7th July, 2018. The Hall has received quite a bit of traffic during the past months due to the Civic Hall and Administration Centre refurbishment which will make the task of cleaning and preparing the Hall for the function a more demanding task for the staff than usual.

I hereby give notice of my intention to move the following motion at the Council meeting of Tuesday, 26 June, 2018:
That Councillors and Council Staff who attend conferences, forums and meetings to represent Council provide a brief written report to be included in the Business Papers for the following Ordinary Council Meeting |
Note from Councillor
Councillors and Council Staff, especially the Mayor, Deputy Mayor and the General Manager, regularly attend conferences, forums and meetings to represent Council. At these meetings they acquire knowledge about various aspects of Local Government. Attendance at these conferences, forums and meetings are paid for by Council.
A brief report would inform other Councillors and the community about the things that were learnt at these forums, especially initiatives and innovations which could be applied to Cootamundra-Gundagai Regional Council.
Such reports would also improve our accountability, in that the community would know what benefit has resulted from this expenditure.

That Council encourage the community to inform Council about any public events that are occurring in the region and, if appropriate, invite Councillors to attend. |
Note from Councillor
Council is committed to ongoing consultation with the community and arranges community meetings at which residents can provide input.
However, community groups and organisations also hold public events, which Councillors (and Council Staff) could attend to hear about issues of interest to the community and to those organisations. Councillors want to be involved in the life of our community but we need to know that these events are on.

Distribution of the CGRC Community Newsletter in the old Gundagai council area are to be delivered to the Gundagai Post Office for local distribution. |
Note from Councillor
This is to support local business which is extremely important. The Gundagai Post Office was down sized a few years ago from a standalone business to being incorporated with the IGA supermarket. Any business which can be sent their way is important.
Also, a number of South Gundagai residents have indicated to me that they are not receiving the Community Newsletter. This needs investigation.

At least one Gundagai staff member (located in Gundagai) be given authority to have access to Council’s main Facebook page. This will allow a local person with local knowledge to add relevant information regarding the Gundagai area then relaying it to Cootamundra personnel to add to Facebook. |
Note from Councillor
In time of critical situations within or outside of working hours it is important to have access from Gundagai office. Prior to the merger Gundagai had the equivalent Facebook page that had a large number of followers and was extremely well run by the Gundagai staff and contained a lot of relevant local material.

Questions with Notice
The following questions with notice from Councillors have been received with the responses from Council officers provided respectively:
Penny Nicholson – Footpath Cleaner is desperately needed in Gundagai. When and how often is this machine scheduled for use between Cootamundra and Gundagai? |
Response from Council Officer – The footpath sweeper was expected to run over the Gundagai footpaths once a week. At the moment we are awaiting a new trailer to transport the unit to Gundagai which has another 3-4 weeks before delivery. |
|
Penny Nicholson – The footpath in front of the old Gundagai Pharmacy is terrible due to the droppings of the swallows that roost underneath the verandah. My understanding is that the footpath is Council’s responsibility, albeit, not Council’s building where the birds roost. Can spike strips be installed to deter the birds? |
Response from Council Officer – Council can undertake investigations on the possible options for deterring the birds nesting. |
|
Penny Nicholson – As a matter of urgency can we please have CGRC Gundagai Office signage installed on the outer wall of the Gundagai Council office? |
Response from Council Officer – Signage for the Administration Centres has been installed in the garden at the front of the Gundagai office. Council has also ordered signage to be applied to the outer office wall. |
|
Penny Nicholson – The shipping container situated in the car park of the Gundagai office contained items of Council with historical importance to the town such as, photos, plaques and other Council memorabilia. Are these able to be retrieved and a suitable area identified to display such items for the public to see? |
Response from Council Officer – At the time of the refurbishment of the Chambers great care was taken in removing precious items for future rehanging. Council has plans to put many of these items on display when the library extension has been completed. As such, nothing of historical significance was placed into the container for removal. |
|
Penny Nicholson – Comment has been made regarding phoning the Council office and the subsequent hold and transfer time when wanting to speak with an officer in either Cootamundra or Gundagai. Could it be considered that an option be “Press 1 for Cootamundra Office, or 2 for Gundagai Office” hopefully to eliminate double handling and wait time. |
Response from Council Officer –In an effort to bring the two offices together, it was decided that one answering system be implemented as most queries can be answered in either office. The transfer time from one office to another is no longer than transferring and internal call. |
